Terms of Service

These Terms of Service govern your use of nextwavehustles.com and purchases from Next Wave Hustles, operated by Brian Cross as a sole proprietor doing business as Next Wave Hustles. By accessing the store or placing an order, you agree to these Terms and the policies incorporated by reference.

Store use

You must be legally capable of entering a binding agreement in your location or use the store with the permission of a parent or legal guardian. You may not use the store for unlawful, fraudulent, abusive, or unauthorized purposes; interfere with store security; introduce malicious code; scrape or copy store content without authorization; or violate another person's rights.

Products, pricing, and orders

We make reasonable efforts to describe products accurately. Colors, displays, and file appearance can vary by device or software. Prices, availability, product details, and promotions may change before an order is accepted. Applicable sales tax is calculated at checkout and added to the displayed product price unless the checkout states otherwise.

Submitting an order is an offer to purchase. We may reject, limit, or cancel an order for suspected fraud, pricing or listing errors, unauthorized resale, technical problems, or other legitimate business reasons. If payment was collected for a canceled order, we will issue an appropriate refund.

Digital products and delivery

Products identified as digital downloads contain no physical item and require no shipping. After successful checkout, digital files or access instructions are delivered electronically to the email address used for the order and may also be available on the order confirmation page. Customers are responsible for entering a valid email address, maintaining compatible software and devices, and saving purchased files.

CREATING MOTION™ includes a printable PDF and a fillable PDF. Its access limit is five downloads per customer unless the product page or order confirmation states otherwise. Contact us if a verified purchaser has a delivery or access problem.

Digital license

Unless a product page grants different rights, digital products are licensed—not sold—for the purchaser's personal or internal business use. The license is limited, non-exclusive, non-transferable, and revocable for material violation of these Terms.

You may not resell, redistribute, sublicense, share download credentials, upload files to public or shared repositories, remove ownership notices, claim the material as your own, or reproduce the product for commercial distribution. You may keep reasonable personal backup copies.

Educational information and results

Digital resources are provided for educational and informational purposes. They are not legal, tax, accounting, insurance, financial, or other professional advice. Business results depend on execution, experience, market conditions, pricing, costs, compliance, and other factors. We do not guarantee income, customers, business success, or any particular result.

Payments and taxes

Payments are processed through Shopify and available payment providers. You authorize the amount shown at checkout, including applicable tax. You are responsible for providing accurate billing and order information.

Refunds, returns, cancellations, and physical fulfillment

Our Return and Refund Policy is incorporated into these Terms. Physical or made-to-order products may also be subject to production, shipping, and fulfillment conditions shown on the product page or checkout. Digital access generally cannot be canceled after delivery except as stated in the Return and Refund Policy or required by law.

Intellectual property

The store, brand names, product names, text, graphics, logos, designs, downloads, and other content are owned by or licensed to Next Wave Hustles and protected by applicable intellectual-property laws. “Next Wave Hustles,” “Hustle Differently,” “CREATING MOTION™,” and related names, systems, and materials may not be used without permission except as allowed by law.

Third-party services and links

The store may use or link to third-party services. We are not responsible for third-party content, availability, security, or practices. Your use of third-party services may be governed by separate terms and policies.

Disclaimer of warranties

To the maximum extent permitted by law, the store and products are provided “as is” and “as available.” We do not warrant uninterrupted access, error-free operation, compatibility with every device or application, or a particular business outcome. Rights that cannot legally be excluded remain unaffected.

Limitation of liability

To the maximum extent permitted by law, Next Wave Hustles and its owner will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or business opportunities arising from the store or a product. Our total liability for a claim will not exceed the amount paid for the product giving rise to the claim. These limits do not apply where prohibited by law.

Governing law

These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law rules, except where mandatory consumer law provides otherwise.

Changes and severability

We may update these Terms by posting a revised version. Changes apply prospectively from the posted effective date. If any provision is unenforceable, the remaining provisions remain in effect.
